Proposition 65 Compliancy

Are Constellation Pro Products Proposition 65 Compliant?
Yes, all Constellation Pro products shipped and sold in the state of California are labeled with the Proposition 65 warning labels.

What is California Proposition 65?
California Proposition 65 (Prop 65) is the Safe Drinking Water and Toxic Enforcement Act of 1986 published as Section 25249.7 of California's Health and Safety Code. Proposition 65 is administered by the Cal/EPA Office of Environmental Health Hazard Assessment (OEHHA) and is enforced by California Department of Justice, Office of the Attorney General. Proposition 65 is intended to warn consumers of potential exposures to chemicals that are recognized by the State as carcinogens and reproductive toxins. Prop 65 applies to all consumer goods sold within the state and impacts all importers, domestic manufacturers, and retailers of these items. Compliance with the law often is difficult due to the lack of OEHHA exposure guidelines for many of the listed chemicals and methodologies for determining compliance are not well defined. Additional ambiguity regarding compliance is created because most of the legal activity is not initiated by the State but rather by private law firms and consumer advocacy groups acting in the public interest.

Why do we place a Proposition 65 warning on our products?
The Prop 65 warning signifies one of two things:

  1. Constellation Pro has evaluated the product and determined that the product is above the “no significant risk level”

  2. Constellation Pro has not evaluated the exposure level of the product, and the warning is provided based on the knowledge about the presence of a listed chemical.
Most Constellation Pro Lighting products are below the Prop 65 level of concern; however, out of general caution, Constellation Pro has chosen to place the Proposition 65 warning on all our products shipped to California.
